2006-2007 Membership

Invoices for the 2006-2007 Hampshire County Bar Association membership were e-mailed or mailed, if no email address was available, to members’ offices on August 1, 2006.

The HCBA also offers special contribution amounts for sustaining membership. Individual lawyers and judges may become sustaining members for an additional contribution of $50.00 to his/her regular membership dues. Firms of two or more lawyers may become sustaining members for an additional contribution of $100.00.

Also, Lawyers Referral Service renewal applications will be emailed to members. The cost for membership in the Lawyer Referral Service is $75.00 in addition to HCBA dues.

Dues for the Bar Association and the LRS were due September 1, 2006. Renewal payments which are not received by December 1, 2006 will result in removal from the HCBA membership roster.

Any questions or concerns regarding membership should be directed to Rebecca Ryan at the HCBA office.

District Court Bench/Bar Committee

The District Court Bench/Bar Committee has not scheduled a meeting for November at this time.

HDC Call of the Jury of Six List - SUSPENDED

On October 25th, Judges Goggins and Dusek-Gomez issued a new order suspending the implementation of the call of the list for the November Jury of Six Session in the Hadley District Court.

The information below had been disseminated but now has been SUSPENDED until further notice

1. You may file a JOINT Call of the List Certificate in lieu of the appearance of either you or your client. I suspect that eventually we will have a standardized form with which to do this, but for now, the document should cover the basic issues that have given rise to this new procedure:

a. The matter is ready for trial (jury or jury waived-non binding);

b. All witnesses are available;

c. There are no outstanding motions in limine, 5th amendment issues, spousal privilege claims, and so on;

d. The matter is ready for a Commonwealth-capped or agreed upon plea (defendant capped pleas must be attempted at the call of the list). There will be no formal announcement or court order in this regard. Please pas along this information amongst your colleagues ASAP.

2. The call of the list will start on November 3rd;

3. There is no call of the list the Friday after Thanksgiving. The week of the 27th will be part of a call of the list on November 17th.

4. Other than the filing of a call of the list certificate, the defendant must appear at the call of the list date set for your case.

5. Both the Commonwealth and Defendant will be held to the representations made on either the certificate or at the call, come the trial date the following week. Obviously, ultimate outcomes will be determined on a case by case basis.

Kinder Inducted

On October 12, 2006 Northampton Attorney C. Jeffrey Kinder was inducted to the Superior Court bench. Kinder spent 13 years in the U.S. Attorney’s Office, where he became Chief of the Springfield office. In 1999 he left to go into private practice in Northampton. Congratulations!

Moriarty Inducted

On September 28, 2006 Holyoke Attorney Cornelius J. Moriarty, II was inducted to the Superior Court bench. Moriarty had been in private practice since 1975. Congratulations!

Dusek-Gomez to step down as Presiding Justice

The Honorable Nancy Dusek-Gomez has decided not to be reappointed to her position as presiding Justice of the Eastern Hampshire District Court. Dusek-Gomez decided that with her plan to retire in five years coupled with the court’s upcoming move to Belchertown that the position would be better served by someone willing to make the commitment needed for the court’s future.

Recent Changes in Elder Law

On Wednesday, November 1, 2006 at 4:00 p.m. in the NDC a seminar, Recent Changes in Elder Law will be presented by Michael Hooker, a Northampton attorney who works exclusively in elder law. Attorney Hooker will present a one hour seminar on the recent federal legislation (the Deficit Reduction Act) and state regulations restricting Medicaid asset protection strategies. These restrictions include an expansion of the three year look-back to five years. All attorneys who work in estate planning need to be aware of these changes and how they impact elders.

Immigration Materials

The Bar Advocates program held an immigration seminar with guest speakers Wendy Wayne and William Graves. If you were not able to attend and are interested in the handouts, they are available via email or you can stop by the office and make a copy.

Domestic Violence Seminar

Presentation of Safety and Accountability Audit Recommendations, a presentation featuring Sarah Buel, a Clinical Professor at the University of Texas Law School who has served battered women for 29 years. The event will take place on Tuesday, December 5, 2006 from Noon – 4:00 p.m. at the Clarion Hotel and is sponsored by the NW D.A.’s office and the City of the Northampton.

Justice Initiative Report

The Report of the Justice Initiative: Recommendations of the Massachusetts Attorney General and District Attorneys to Improve the Investigation and Prosecution of Cases in the Criminal Justice System is available for review at the Bar Association office. Recommendations contained in the report include areas of eyewitness identification, interrogation, forensics, training and resources.

WNEC Mentor Program

The Mentor Program of Western New England College School of Law is looking for attorneys to serve as mentors to students to the legal profession. Mentors will provide, among other things, a perspective on the role of the lawyer in the community and information about issues in legal practice, networking, and job search strategies and skills. Mentors will be assigned between one and two mentees.

An opening reception will be held at the School of Law on Thursday, February 1, 2007, at 5:00 p.m. Mentors and students can meet and establish goals for their individual mentoring relationship. Attendance to the reception is not necessary to be a mentor.

HampdenCBA’s Executive Director to Retire

Judith K. Potter, Executive Director of the Hampden County Bar Association will retire on December 31st after 32 years. Stop by and wish her well in her retirement!

HampdenCBA Names New Executive Director

Noreen Nardi, currently the Assistant Executive Director has been selected to become the Executive Director effective January 1, 2007. Congratulation!

Barbalunga Retires

Pittsfield District Court Judge Alfred A. Barbalunga officially retired on September 13, 2006. Barbalunga served as a district court judge since his appointment in 1980. Best Wishes!

Pellegrino’s Unveiling

The unveiling of the portrait of the Honorable Joseph A. Pellegrino, retired justice of the Hampden County Juvenile Court will take place on Thursday, October 5, 2006 at 4:00 p.m. in Courtroom #1, second floor, Hampden County Juvenile Court, 80 State Street, Springfield. There will be a reception immediately following.

Judge Cooley Guest Speaker

Judge Sidney Cooley, Ret. will be a guest speaker at the event, Artifacts: Personalizing History, on Sunday, November 5, 2006 from 1:00 – 4:00 p.m. at the Holocaust Education Center located at 1160 Dickenson St. in Springfield. The event is free and open to the public.

Limited Assistance Pilot Project

Beginning November 1st modest means litigants will have access to volunteer attorneys for "limited scope" representation under a plan being launched in Springfield and Boston. The purpose of the project is to reduce the volume of pro se cases.

USDC – W. Div. Mandatory Electronic Filing

Effective January 1, 2007, Local Rule 5.4 shall apply to the Western Division of the U.S. District Court. Local Rule 5.4 requires that all filings in the District Court be made by electronic means.

BBO Vacancy

The Justices of the Supreme Judicial Court invite applications for appointment to the Board of Bar Overseers.

In December 2006, several vacancies will occur due to the expiration of the terms of incumbent members. Appointments are made for a term of four years.
